- To join a game using the invite, click on ‘Join’ and enter the code that has been shared with you.

TERMS AND CONDITIONS CADBURY CELEBRATIONS JIO RAKHI CAMPAIGN
This Cadbury Celebrations Rakhi campaign called #CloserThisRakhi (hereinafter referred to as "Campaign") is an initiative of Mondelez India Foods Private Limited having its registered office at Unit No 2001, 20th Floor, Tower-3 Wing-C, Indiabulls Finance Centre, Parel, Mumbai - 400 013 (“Mondelez”) in association with Jio Platforms Limited. (“Jio”). Please read these terms and conditions ("T&Cs") before participating in this Campaign.
Participation in this Campaign is voluntary. You agree that, if you chose to participate in this Campaign, you will be bound by these T&Cs and you acknowledge that you satisfy all Campaign eligibility requirements as provided herein below.
Mondelez has engaged with Jio to organize and run the Campaign (hereinafter referred to as “Campaign Partner”) which shall be hosted on JioEngage platform on MyJio application (hereinafter referred to as “JioEngage”).
Mondelez has partnered with Amazon India Pvt. Limited to facilitate the redemption of coupons offered as part of a promotion activity on the Cadbury Celebrations Pack for the Campaign. Jio and Amazon India Pvt Limited are hereinafter together referred to as “Execution Partners”.
For the purposes of these T&Cs, wherever the context so requires "You" or "Your" shall mean any natural person who is a participant in the Campaign and "We" or "Our" or “Us” or “Mondelez” shall mean Mondelez India Foods Private Limited.
You need to fulfil the following eligibility criteria to participate in the Campaign:
(i) You need to be a natural person; (ii) You should be an individual legal resident of the Republic of India; (iii) You should be of an age 18 years or above at the time of entry into the Campaign; (iv) You shall be legally competent to enter into binding contract under the applicable laws of India.
All who fulfil the eligibility criteria to participate in the Campaign shall individually be referred to as “Participant” and collectively as “Participants”.
Our or Campaign Partner’s or Execution Partner’s and their respective employees, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and their affiliates, advisors, advertising/ Campaign agencies are not eligible to participate or avail any benefits under the Campaign.
- DETAILS OF THE CAMPAIGN AND HOW TO ENTER:
a. This Campaign will commence from 12:00 AM on 25th July 2020 and end at 11:59 PM on 3rd August 2020 ("Campaign Period"). Any entries before or after the Campaign Period will not be considered. We reserve our right to cancel/modify/extend the Campaign Period or the T&Cs applicable to this Campaign as per our discretion and without giving any prior notice to You. No claims/questions shall be entertained in this regard. The campaign shall be available PAN India.
b. In order to be eligible for the Campaign, during the Campaign Period, you must visit MyJio.
c. You must follow the following steps to participate in the Campaign (i) Users who do not have the MyJio app installed on their phone will have to download it from the Android Play Store/ Apple Store, as applicable and data charges and expenses of the same will be borne by the user. Jio mobile SIM customers (users) will be automatically logged into MyJio App. Non-Jio users will have to complete the registration through an OTP process. OTP is generated as soon as you submit your Mobile number. In case it is not received, please check the number you have entered and click the ‘Re-send’ button. (ii) If you have seen the notifications/ advertisement or otherwise come across the Celebrations Rakhi Campaign Banner on JioEngage, MyJio, Jio TV or Jio Cinema you are required to click on the banner which will lead to the Campaign page under JioEngage on MyJio (“Banner”). (iii) You will see a visual of loading screen with a check box to accept T&C’s. Select that check box and move ahead. (iv) You will then be shown the “How to Play” screen. Read that and click on continue. (v) You will then need to select your gender and enter your nickname. (vi) A new Quiz will be set for each day at 12 AM during the Campaign Period. (vii) On entering the Campaign, Quiz for the respective day shall be unlocked. • If you are entering the campaign during 25th to 31st July, you will be able to see status of each days’ Quiz which you have attempted or missed. • If you are entering the campaign during 1st to 3rd August, only the Quiz for the respective day, shall be visible. • If you miss the quiz for any specific day and enter the engagement on subsequent days, you will not be allowed to play the quiz for previous days that you have missed. (viii) On moving ahead, you can invite or join your sibling for a Quiz: • Where you invite your sibling (“Host”), you need to click on ‘Invite’. You will enter Quiz Room where you select a mode of inviting through native apps available on your device and then send the message with an invite link and code with your sibling. Wait for your sibling to join. • Where you want to join your sibling (“Invitee”), click on the invite link shared by your sibling and you will land on the Campaign page. After accepting T&Cs and entering gender and nickname, you need to click in ‘Join’. Enter the code shared in the message. You will join your sibling in Quiz Room. • Once Host and Invitee (“individually referred to as Participant(s)”) enter the Quiz Room, Host can start the Quiz. (ix) Quiz shall have 5 (five) time barred questions. Participants can answer the questions in the given time frame / timer shown on the Quiz page. If both siblings answer before the timer ends, the next question will be shown. If only one sibling answers, and the question remains unanswered after timer ends, next question to be shown. If none of the siblings answers, next question shall appear after timer ends. (x) At the end of the Quiz, result screen shall be shown with ‘Score’ attained. Score shall be calculated as percentage of questions answered in sync by both the siblings out of total 5 questions asked.
- PRIZES AND WINNER SELECTION: Mondelez may at its sole discretion can add, delete or modify, without any prior intimation (i) Type and count of Prizes available; (ii) Eligibility criteria for qualifying and winning Prizes; (iii) Count of Winners (hereinafter defined); (iv) Special Terms and Conditions (hereinafter defined) for redemption of Prizes; or (v) Any other aspect related to Prizes and Winner selection. Subject to aforementioned, below are the Prizes available on offer during the Campaign Period:
a) ‘INR 50 Off Amazon Coupon’ for Participation: (i) INR 50 Off Amazon Coupon shall mean ‘INR 50 off on purchase of Cadbury Celebrations Pack’ from Amazon. (ii) A Participant who completes the entire user journey to reach the results screen and Score is generated for such Participant (regardless of having answered any or all questions), at least once during the Campaign period shall be eligible for INR 50 Off Amazon Coupon (“Eligible Contestant for Participation Prize”). Mondelez may also adopt any other methodology or criteria at its sole discretion for selecting Eligible Contestant for Participation Prize. For example: • Eligible Contestant for Participation Prize can be one who is a Host, has completed the entire user journey to reach the results screen and Score is generated for such Participant (regardless of having answered any or all questions), at least once during the Campaign period. • Eligible Contestant for Participation Prize can be one who is a Host or Invitee, has attempted at least one question during the Campaign period, etc. (iii) Mondelez may determine such 20,000 Eligible Contestant(s) for Participation Prize each day as “Participation Prize Winner(s)” on first come first serve basis and award INR 50 Off Amazon Coupon. Mondelez reserves the right to determine any number of Eligible Contestant(s) for Participation Prize as the “Participation Prize Winner(s)” at its sole discretion without any prior intimation. (iv) Participants can participate in the Campaign multiple times during the Campaign Period, however each participant is eligible to win INR 50 Off Amazon Coupon only once during the Campaign Period. (v) Each day, first 20,000 Eligible Contestants for Participation Prize shall be awarded INR 50 Off Amazon Coupon on first come first serve basis subject to clause 3(a)(iii) above. Mondelez may adopt any other methodology or criteria at its sole discretion to award INR 50 Off Amazon Coupon to Participation Prize Winners. (vi) INR 50 Off Amazon Coupon won will get reflected in “My Winnings” tab under “Prizes” section of the Campaign. (vii) Special Terms and Conditions applicable for INR 50 Off Amazon Coupon are given in Annexure 1.
b) ‘Additional Data Voucher’ on successful Quiz completion: (i) “Additional Data Voucher(s)” shall mean additional data packs of RJIL with denominations as (i) 1 GB; or (ii) 750 MB; or (iii) 500 MB; or (iv) 250 MB or any other denomination(s) as may be determined by Mondelez at its sole discretion. (ii) Each day during the Campaign Period, Participant(s) who have successfully answered all questions and such answers are in 100% sync with their sibling i.e. achieved a 100% score, shall be eligible to win Additional Data Voucher(s) of RJIL (“Eligible Data Participants”). Mondelez may also adopt any other methodology or criteria at its sole discretion for selecting Eligible Data Participant. For example: • Eligible Data Participant can be one who is a Host, has successfully answered all questions and such answers are in 100% sync with the Invitee i.e. achieved a 100% score. • Eligible Data Participant can be one who is a Host or Invitee, has completed the entire user journey to reach the results screen and Score is generated for such Participant regardless of whether the Score is 100% or not, etc. (iii) Mondelez may determine such 19,000 Eligible Data Participant(s) each day as “Data Prize Winner(s)” on first come first serve basis and award Additional Data Voucher. Mondelez reserves the right to determine any number of Eligible Data Participant(s) as “Data Prize Winner(s)” at its sole discretion without any prior intimation. (iv) Participants can participate in the Campaign and achieve 100% score multiple times during a day in the Campaign Period, however each participant shall be eligible to win Additional Data Voucher only once in a day. (v) Each day, first 19,000 Eligible Data Participants shall be awarded Additional Data Voucher on first come first serve basis i.e. per day first 500 Eligible Data Participants shall get 1 GB Additional Data Voucher, next 500 Eligible Data Participants shall get 750 MB Additional Data Voucher, next 9,000 Eligible Data Participants shall get 500 MB data, and remaining 9,000 Eligible Data Participants, subject to clause 3(b)(iii) above, shall get 250 MB data. Mondelez may adopt any other methodology or criteria at its sole discretion to award Additional Data Voucher of any denomination(s) to Data Prize Winners. (vi) Additional Data Voucher won will get reflected in “My Winnings” tab under ‘Prizes’ section of the Campaign. However, such Additional Data Voucher will be credited to the account to Data Prize Winner only if such Data Prize Winner is an active subscriber of telecommunication services of RJIL on the day of credit and has used such registered mobile number of RJIL to participate in the Campaign. (vii) Special Terms and Conditions applicable for Additional Data Voucher are given in Annexure 1.
c) Bumper Prize(s): (i) Bumper Prize(s) shall mean (i) 1 year subscription plan worth INR 2121 of RJIL; or (ii) INR 500 Off Amazon Coupon; or (iii) 1 Month JioSaavn Pro Subscription Voucher. (ii) A Participant is eligible for Bumper prize only when such Participant has completed the entire user journey in 100% sync i.e.; achieved 100% Score on all 7 consecutive days from 25th to 31st July, 2020 (“Eligible Bumper Participants”). Mondelez may also adopt any other methodology or criteria at its sole discretion for selecting Eligible Bumper Participant. For example: • Eligible Bumper Participant can be one who is a Host, has completed the entire user journey in 100% sync with the Invitee i.e. achieved a 100% score on all 7 consecutive days from 25th to 31st July, 2020. • Eligible Bumper Participant can be one who is a Host or Invitee, who has completed the entire user journey to reach the results screen and Score is generated for such Participant on all 7 consecutive days from 25th to 31st July, 2020, regardless of whether such Score is 100% or not, etc. (iii) Mondelez may determine such 1,700 Eligible Bumper Participant(s) as “Bumper Prize Winner(s)” on first come first serve basis and award Bumper Prize. Mondelez reserves the right to determine any number of Eligible Bumper Participant(s) as “Bumper Prize Winner(s)” at its sole discretion without any prior intimation. (iv) Each Eligible Bumper Participant can win only one Bumper Prize during the Campaign Period. (v) On 7th day (i.e. 31st July, 2020), first 1,700 Eligible Bumper Participants shall be awarded Bumper Prize on first come first serve basis i.e. first 50 Eligible Bumper Participants shall get 1 year subscription plan worth INR 2121 of RJIL, next 200 Eligible Bumper Participants shall get INR 500 Off Amazon Coupon, next 950 Eligible Bumper Participants shall get 1 Month JioSaavn Pro Subscription Voucher and remaining 500 Eligible Bumper Participants, subject to clause 3(c)(iii) above, shall get INR 500 Off Amazon Coupon. Mondelez may adopt any other methodology or criteria at its sole discretion to award any of the available Bumper Prizes to Bumper Prize Winners. (vi) Bumper Prize won will get reflected in “My Winnings” tab under ‘Prizes’ section of the Campaign. However, such Bumper Prize constituting 1 year subscription plan worth INR 2121 of RJIL, shall be credited to the account to Bumper Prize Winner only if such Bumper Prize Winner is an active subscriber of telecommunication services of RJIL on the day of credit and has used such registered mobile number of RJIL to participate in the Campaign. (vii) Special Terms and Conditions applicable for Bumper Prizes are given in Annexure 1.
- ADDITIONAL TERMS:
(i) Mondelez may, at its sole discretion, change the T&Cs or cancel the Campaign at any time; or modify, terminate, or suspend the Campaign for any reason including in the event of viruses, worms, bugs, unauthorized human intervention, government restrictions or other causes that are beyond our control that corrupt or impair the administration, security, fairness or proper play of the Campaign or submission of entries.
(ii) We will not be responsible for (including but not limited to): (a) any SPAM generated messages; (b) any SMS message delivery failures; (c) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by You or by any of the equipment or programming associated with or utilized in the Campaign, or by any technical or human error that may occur in the processing of entries; (d) any printing or typographical errors in any materials associated with the Campaign; (e) any technical or operational issue in the JioEngage and/or MyJio restricting or preventing your participation in the Campaign or availment of your Prize; (f) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the internet or at any website; (g) injury or damage to Your or any other computer or mobile resulting from downloading any materials in connection with the Campaign; (h) other conditions beyond Our reasonable control.
(iii) We, in our sole discretion reserves our right to exclude You from Campaign and/or not to attribute the Prize, and/or to cancel all or part of the Campaign, without any liability on our part, if We believe You have (a) breached any of these T&Cs; (b) acted or have the intention of act in a dishonest or fraudulent manner, or in bad faith; (c) tampered with the entry process or the operation of the Campaign; (d) acted in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.
(iv) If Your entry is incomplete or if You use robotic, automatic, programmed or similar entry methods, your entry will be void. The authorized subscriber of MyJio account used to enter the Campaign at the actual time of entry will be deemed to be the participant and must comply with these T&Cs in the event of a dispute as to entries submitted by multiple users having the same MyJio account. The authorized account subscriber is the natural person who has successfully signed in to their MyJio application account. No benefits greater than those described in these T&Cs shall be awarded.
(a) Participation in this Campaign is at your sole discretion and on a voluntary basis.
(b) You agree that all decisions taken by Mondelez and/or Campaign Partners related to the Campaign are final and binding on You. Failure by Us to enforce any of these T&Cs in any instance shall not be deemed to be a waiver of the T&Cs and shall not give rise to any claim by any person.
(c) We will not be liable for any costs incurred by You in connection with Your participation in the Campaign. We will not liable if the Participants do not have mobile phones that support the Campaign.
(d) Announcements and information about the Campaign shall be posted on JioEngage tab under MyJio – please refer to the T&Cs section and My Winnings for any details.
(e) If you are dissatisfied with the Campaign or the Campaign rules and/or any content or any requirements of the Campaign form, the materials available related thereto, or with these T&Cs, his/her sole and exclusive remedy is to not participate in the Campaign.
(f) If a person chooses to access this Campaign from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.
(g) All users of JioEngage and / or MyJio who are smart phone users (Android / iOS) are allowed to participate in this campaign. This campaign is not available for Jio Phone users.
(h) In the event of death of a Participation Prize Winner or Data Prize Winner or Bumper Prize Winner (collectively referred as “Winners”), no nominees or heirs or any other person shall be eligible to the prize and no claim from the nominee or his/her legal heirs of the Winner or any other person shall be entertained for receiving the prize.
(i) All applicable taxes resulting from acceptance of Prize(s) shall be the responsibility of Winners.
(j) Neither Mondelez nor the Campaign Partners are propagating breaking social distancing norms or government directives and reference to #CloserThisRakhi is to emotional closeness.
- INTELLECTUAL PROPERTY RIGHTS:
All right, title and interest, including but not limited to the intellectual property rights, in the promotional material(s) and all Campaign related material shall vest solely and exclusively with Mondelez at all times. All material submitted in connection with the Campaign by the Participant (whether written, electronic or visual form, or a combination of those) or any photographs linked to your participation in connection with the Campaign are assigned to Mondelēz and Jio upon participation and become the property of Mondelēz and Jio exclusively. Mondelēz and Jio may use the material in any medium in any manner it sees fit in connection with the Campaign. All intellectual property, including without limitation, any copyrights, trademarks, designs and know how (“Intellectual Property”) relating to Mondelez products shall belong to Mondelez. All Intellectual Property related to the Campaign, JioEngage and/or MyJio and those owned exclusively by the Execution Partners shall at all times continue to belong to the respective Execution Partners.
- PERSONAL INFORMATION:
(i) You agree that for the purpose of operating this Campaign, Execution Partners may collect personal and/or sensitive personal information (“Personal Data”) from You. Such Personal Data will be used by Mondelēz and/or the Execution Partners for the purpose of operating this Campaign. Providing Personal Information is voluntary; however, failure to provide such data shall result in your inability to participate in the Campaign. Participants eligible for a Prize give their consent to the collection and processing of such Personal Information. Please note that your acceptance of these terms and conditions is deemed to signify your agreement to collection, use, transfer, storage, handling or otherwise processing your Personal Data in accordance with terms hereof.
(ii) We reserve the right to refuse to issue Prizes to the winners unless they provide their Personal Data necessary to release the Prize and to perform other activities to run the Campaign.
(iii) Participants authorize Execution Partners to use the Personal Data sent to the Campaign in connection with the Campaign.
(iv) By accepting these terms and conditions you also hereby give your consent to Mondelez or any other third party nominated by Mondelez to carry out profiling of your anonymized data made available through JioEngage and/or MyJio and for this reason transfer of your Personal Data to such third parties. Mondelēz and/or Campaign Partner will take the necessary measures to secure and keep safe, either directly or through third parties, any such information that You may have shared. In case of any grievance relating to storage of your Personal Data you may report the same by using any of the modes of raising complaints as provided on JioEngage and/or MyJio.
(v) It is important to remember that whatever You transmit or disclose can be collected and used by others or unlawfully intercepted by third-parties. No data transmission can be guaranteed to be 100% secure. While We strive to use commercially reasonable means to protect Your information, We cannot warrant the security of any information You transmit to us.
(vi) Your personal information may be retained and may continue to be used until: (i) the relevant purposes for the use of Your information described in this clause are no longer applicable; and (ii) We and/or Campaign Partners are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain Your personal information and the retention of Your personal information is not required for the establishment, exercise or defense of any legal claim.
- FORCE MAJEURE:
This Campaign is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God, government restrictions or any circumstance beyond the reasonable control of Mondelēz/ Campaign Partner/ Execution Partner ("Force Majeure Event"). We / Campaign Partner / Execution Partner shall not be liable for any delay or adverse effect caused to the Participants in the Campaign including the winners as a result of a Force Majeure Event.
- GOVERNING LAW AND JURISDICTION:
The courts of competent jurisdiction at Mumbai shall have sole and exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Campaign. Participation in the Campaign is unauthorized in any jurisdiction that does not give effect to all provisions of these T&Cs, including (without limitation) this clause.
Further all issues and questions concerning the construction, validity, interpretation and enforceability of these T&Cs, or the rights and obligations of the participants and/or Mondelez and/or Campaign Partner and/or Execution Partner shall be governed and construed in accordance with the laws of the Republic of India.
- PUBLICITY RELEASE:
By participating in the Campaign, you give Mondelēz and/ or its affiliates irrevocable and unconditional permission to collect, use, store, transfer or other handle/process your Personal Data including your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the Campaign and any promotions, events, or Campaigns to follow including to cover the Campaign and Your participation through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and that You shall not raise any objection, protest or demur to such coverage or in this regard. These uses also include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation for any of the aforementioned use including use of Your pictures and hereby release Mondelez and/ or its affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use.
- LIABILITY RELEASE:
This Campaign is being made purely on a "best effort" basis and participating in this Campaign is voluntary. By participating in the Campaign, you will be legally bound hereby, to release from liability, and hold harmless Mondelez and any of its / their affiliates, employees or agents representing or related to Mondelez and its / their services/products for any matters in relation to this Campaign, including the Prizes or for any errors and omissions or any illegal acts by You or non-compliance with any Government directives. This release is for any and all liability for personal injuries (including death), property loss or damage, and misuse of the benefits/ Prizes offered under this Campaign, in connection with any activity or directly or indirectly, by reason of the acceptance, possession, or participation in the Campaign, even if caused or contributed to by our negligence. By participating in this Campaign, you agree to indemnify and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the Prize or participation in the Campaign including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some illegal, negligent act or omission, or otherwise. You shall be liable for all the personal taxation that might arise out of the winnings from this Campaign and shall not hold Mondelez and/ or its affiliates responsible for payment of the same and/ or any dispute arising in relation thereof.
